HS code 3926 for plastic articles

Heading 3926 covers other articles of plastics. For a moulded housing, the first question is whether it is a general article or a part of an electrical apparatus.

Key takeaways

  • 3926 is the residual heading for other articles of plastics, after the specific chapter 39 headings.
  • A moulded housing that is a dedicated part of a switch can be classified in 8538, not 3926.
  • Insulating fittings whose main job is insulation can fall in 8547.
  • The material, the function and the degree of dedication decide the heading. The polymer name alone does not.

What heading 3926 covers

Heading 3926 covers other articles of plastics and articles of other materials of headings 3901 to 3914. It sits at the end of chapter 39, after the headings for polymers, semi manufactures, tubes, sheets, packaging and builders ware.

The heading covers a wide range of finished plastic items: clips, covers, cases, handles, knobs, spacers, insulators and housings. It is a residual heading, so it applies only when no more specific heading covers the goods.

The word plastics has a defined meaning in the chapter. It includes materials that can be formed by heat or pressure, and it includes some composite materials. A part made from a thermoset moulding compound can still be a plastic article for classification purposes.

The chapter also covers articles made from waste or scrap plastics, provided they are worked into a finished item. Recycled content does not change the heading. What matters is the material family, the product form and the function, not the source of the polymer.

The chapter 39 ladder

Chapter 39 starts with polymers in primary forms and moves through semi manufactures to finished articles. The product form decides the heading before the function is considered.

A moulding compound in granule form is a primary polymer. An extruded profile is a semi manufacture. A sheet is a sheet heading. A moulded housing is an article. The same polymer can appear at several points in the chapter depending on the form at import.

That is why the import description should say what is in the box, not what the material is called. A bag of resin and a finished housing are not the same goods, even if the datasheet is identical.

The table is a prompt for the headings to check. The heading text and chapter notes decide the actual code.

Article or part of an apparatus

A moulded plastic part can be a general article in 3926 or a dedicated part of an electrical apparatus in chapter 85. The distinction is dedication. A housing that is designed only for a particular switch, with the mounting features and the creepage distances for that switch, is a part of that switch. A generic enclosure that could hold many products is closer to a 3926 article.

Parts of the apparatus in 8535, 8536 and 8537 are classified in 8538. That heading covers identifiable parts, including moulded housings, covers and contact carriers. If the drawing references the parent switch, the case for 8538 is stronger.

Insulation adds another route. Heading 8547 covers insulating fittings for electrical machines, appliances or equipment, where the main function is insulation. A moulded insulator that is dedicated to a busbar or a terminal can fall there rather than in 3926.

Dedication is the deciding fact

A part number, a parent assembly and a drawing that references one product are stronger evidence than a material datasheet.

A moulded housing worked through

Take a glass filled polyamide housing for a miniature circuit breaker. It has a specific shape, mounting clips for the mechanism, arc barriers and a front aperture for the toggle. It is not a general purpose box.

The housing is a part of an electrical apparatus. The likely heading is 8538, because it is identifiable as a part of a switch. The material and the flame retardant grade support the product specification, but they do not decide the heading.

Now take a plain terminal box with no fitted contacts, sold to installers as a general enclosure. That is closer to 3926 or to 8536 depending on whether it is equipped for connection. The presence of terminals, gland plates and a rated voltage changes the analysis. The product as presented decides.

The same logic applies to a cover, a handle or a mounting foot. A cover that is moulded to fit one switch and carries the switch marking is a part of that switch. A standard cover sold in several sizes is a general article. The part number and the catalogue page usually show which one it is.

If the part is supplied as a set with metal contacts, the set is not a plastic article. The assembly may be a complete apparatus or a part of one. Split the description by what is in the bag, not by what the buyer will do with it.

Material and the subheading

At six digits, 3926 separates a few product types from the residual group. There are subheadings for office and school supplies, apparel accessories, furniture fittings and ornamental articles. Everything else falls into the general other subheading.

National schedules then split the residual group by polymer or by application. A polycarbonate cover and a polypropylene cover can land on different lines. The material datasheet should state the polymer and the grade, not just a trade name.

The same applies to the moulding route. A part moulded from a compounded grade and a part machined from a cast nylon block can share a function but not a production route. The route belongs on the record because it supports the description and the value.

Fillers and reinforcements are part of the grade. A 30 percent glass filled polyamide is not the same material as an unfilled polyamide, even if both are called PA66 on the drawing. Record the grade from the datasheet and keep the datasheet version with the file.

If the grade changes, treat it as a new classification question rather than a minor revision.

Additives matter for the product specification and sometimes for the tariff. Flame retardants, glass fibre and mineral fillers change the grade. Keep the datasheet with the classification record so the description can be supported.

A classification method for a moulded part

Start with the product as imported, then test the specific headings before falling back to the residual. Record why each alternative was rejected.

  1. 01

    Describe the part

Material, moulding process, function and parent assembly.

  2. 02

    Check semi manufactures

Is it a profile, sheet, tube or film rather than an article?

  3. 03

    Check dedication

Is it a part of an electrical apparatus? Check 8538.

  4. 04

    Check insulation

Is the main function insulation? Check 8547.

  5. 05

    Apply 3926

Use the residual heading and choose the subheading.

  6. 06

    Record the evidence

Drawing, datasheet, parent reference and review date.

Confirm the code and rate

The duty rate for a 3926 line depends on the destination tariff, the origin of the goods and any measures in force. Do not assume that a plastic part carries a low rate or that a previous entry is still correct.

The destination tariff, a customs broker or a written ruling should confirm the code. For a moulded part with a long production life, an advance ruling is worth the effort because the tooling cannot be changed quickly if the classification moves.

Records to keep

Keep the drawing, the material datasheet, the parent assembly reference and the classification rationale together. If the part is a dedicated component, keep the document that shows the dedication. If it is a general article, keep the catalogue page that shows it is sold as a standard item.

Review the record when the design, the material or the supply route changes. A new moulder in a different country can change the origin and the preferential treatment even when the drawing is unchanged.

Store the record with the part file rather than in an email thread. The person who handles the next shipment may not be the person who built the classification, and a short file with the drawing, the datasheet and the rationale is easier to hand over than a long chain of messages.

Frequently asked questions

What is HS code 3926?

It is the residual heading for other articles of plastics, covering finished plastic items that are not classified in a more specific chapter 39 heading or elsewhere in the tariff.

Is a plastic switch housing classified in 3926?

It can be, but a housing dedicated to a particular switch is more likely to be a part of that switch in heading 8538. The drawing and the parent assembly decide.

What is the difference between 3926 and 8547?

3926 covers general plastic articles. 8547 covers insulating fittings for electrical equipment where the main function is insulation. A dedicated insulator can fall in 8547.

Does the polymer type change the HS code?

At six digits, 3926 is mostly a residual heading. National schedules may split it by polymer or application, so the material datasheet should state the polymer and grade.
